Terms and Conditions for the Campaign

The following terms and conditions (the “Terms and Conditions”) shall apply to “SHMEI Creative Snap & Share” Daikin CNY 2024 Campaign (the “Campaign”). The campaign comprises of Creative Photo and Video Challenge (the “Challenge”) that is to be hold on Facebook, Instagram and TikTok.

Eligibility

  1. The Campaign opens to all Malaysian citizens aged above 18 who are residing in Malaysia.
  2. Employees of Daikin Malaysia, related companies and affiliates and/or the immediate families of such employees, dealers of Daikin Malaysia, sub-contractors or companies or any other party directly related to this Campaign are not eligible to participate in the challenge.
  3. Daikin Malaysia has the sole discretion to exclude any persons from participating in the Campaign without any obligation to furnish any notice and/or reason.

Campaign Period

  1. The Campaign opens from 26 January 2024 to 24 February 2024, 11.59pm. Both dates inclusive the “Campaign Period”.

Participation in the Campaign

  1. Start taking your photo or video creatively during the campaign period with including the below requirements:
    • Shmei (handsome and pretty) style
    • Include the song “Shmei – Haoren, Priscilla Abby, Thomas Kok, Daniel, Isaac Voo, Steady Gang, Wooby Gan” as background music
  1. Publish your creative photo or video in either one platform (Facebook, Instagram or TikTok) with writing caption of “What do you think is the most perfect thing about Daikin?”
  2. Set your post to public with tagging Daikin Malaysia’s Facebook, Instagram or TikTok official accounts and hashtag #100Shmei #DaikinCNY2024 #Daikin100Years for easy tracking.
  3. Like and follow Daikin Malaysia Facebook, Instagram or TikTok official account.
  4. Winners will be announced within one (1) week after contest ends.

Prizes

  1. There will be a total of ONLY TEN (10) PRIZES to be won at the end of this campaign. Each winner will be entitled to win one (1) MC30 Streamer Air Purifier (worth RM570 each).

Prizes Collection

  1. Each winner is only entitled to win one (1) prize regardless of the number of times the creative photos or videos are posted.
  2. The winners will be selected by Daikin Malaysia based on the creativity of the photo or video they posted.
  3. Winners will be announced in Daikin Malaysia Official Facebook, Instagram and TikTok. All the winners will need to provide their details to dmss.marketing@daikin.com.my in seven (7) days after the winners’ announcement.
  4. Daikin Malaysia’s decision of the Campaign is final and no appeals or correspondence will be entertained. The Participants shall accept and abide by any and all decisions made by Daikin Malaysia.
  5. The winners must produce the necessary information as required by Daikin Malaysia e.g. Name, Phone Number, NRIC or works permit pass (Passport number), home address and email address for the prize collection purpose.
  6. Prizes of air purifiers must be collected at Daikin Malaysia Sales & Service Sdn Bhd Headquarter or branches during operating hours.
  7. If the prizes are unclaimed after one (1) month of the announcement of the winners, such prize(s) shall be forfeited and no compensation will be given in such circumstances.
  8. The Campaign prizes are non-transferrable, non-exchangeable and are not redeemable for cash, other prizes or any other products from Daikin Malaysia. Daikin Malaysia has the right to substitute any prize for a prize of equivalent value without prior notice or reason.
  9. Daikin Malaysia accepts no responsibility for any tax or other liability that may arise from the prize winnings.

Personal Information Provided by Participants

  1. Daikin Malaysia shall use and take care of any personal information Participants supply to it as described in its privacy policy and in accordance with data protection legislation. By participating in the Campaign, Participants are agreeable to the collection, retention, usage and distribution of the personal information in order to process and contact the Participants about the Campaign entry, and for the purposes set out herein.
  2. The information may be utilized in the following manners:
    1. Details which consist of personal data provided by Participants may be used by Daikin Malaysia for the following purposes:-
      1. The processing of your Campaign Participants;
      2. The operations and process in this campaign;
      3. Updating our records about the Participants;
      4. Market research and statistical analysis and surveys with the aim of improving Daikin Malaysia products and services;
      5. For advertising and promotion purposes; and
      6. For any purposes required by law or regulation.
    2. Daikin Malaysia may collect, use, disclose and share amongst themselves, Daikin Malaysia’s agents and respective service providers, the Participants’ personal data, including the photographs or audio-video or other recordings of these Participants (“Material”) for publicity and/or use in advertisements across all media, including, without limitation, in Daikin Malaysia’s publications, presentations, promotional materials on their websites, in its original or edited format, and whether to promote the Contest / Lucky Draw or otherwise without further notification, remuneration or compensation.
    3. Other than those individuals and entities mentioned above, or as informed from time to time, your personal data will not be revealed by Daikin Malaysia to any other outsiders, unless Daikin Malaysia has required your permission to do so.
    4. By participating this campaign, you agree and accept to Daikin Malaysia Sales & Service Sdn. Bhd. (“DMSS”) privacy policy and consent to collect, obtain, store, use, process and disclose your personal data in accordance with the purposes as stated in the privacy policy. General Terms and Conditions:

  1. Daikin Malaysia shall not be liable to any persons in the Campaign for any injuries, losses and/or damages in respect of, in connection with and/or arising from the Campaign.
  2. Daikin Malaysia reserves the right to video, photograph, record and/or publish any Participants’ images and details for the purpose relating to the publicity of the Campaign without having to pay any fee or compensation to the Participants.
  3. Daikin Malaysia reserves the right to vary and/or alter the term and conditions of the Campaign at any time without prior notification.
  4. Daikin Malaysia reserve the rights to remove, suspend or ban any participant in sole discretion and without prior notice in any case whereby it is found that participants fail to comply with these terms; suspect of fraud or suspicious/manipulative activity by a participant.
  5. In the event of any inconsistency between these terms and conditions and any brochures, marketing or other promotional materials or communications relating to the Campaign, these terms and conditions shall prevail.
